Terms of Service

Welcome to BarrioDesk ("the Platform"). The Platform is a proprietary software-as-a-service application owned, operated, and maintained by WKNDPRJKT ("we," "us," or "our").

By accessing or using the Platform, you ("the User," representing community administrators, homeowners, occupants, or security personnel) agree to be bound by these Terms of Service ("Terms") and all applicable laws of the Republic of the Philippines. If you do not agree to these Terms, you must not access or use the Platform.

1. Scope of Services

BarrioDesk provides digital tools designed to assist subdivisions, villages, and condominium homeowners' associations (each, a "Community Association") in managing community directories, tracking dues, recording ledger events, scheduling gate passes, and resolving support tickets.

2. Limitation of Financial Liability

  • Software Provision Only: BarrioDesk is an operational helper tool. We do not act as an escrow agent, financial institution, bank, or payment processor. All financial transactions, dues collections, cash bank reconciliations, and penalty assessments are the sole responsibility of the respective Community Association's Treasurer and Board of Trustees.
  • Audit Responsibility: We make no warranties, express or implied, regarding the mathematical absolute accuracy of ledger balance adjustments inputted manually by HOA administrators. It is the sole obligation of the Community Association to audit its accounts book registers, balance sheets, and tax reports.
  • No Dispute Mediation: We are not party to, and will not mediate or participate in, financial disputes between homeowners, tenants, and the Community Association Board of Directors.

3. User Accounts and Acceptable Use

  • Account Credentials: Users are responsible for safeguarding their login credentials (powered by Supabase Auth). Any activity originating under your account is deemed your responsibility.
  • Truthful Submissions: Administrators and homeowners must submit only valid, truthful records (such as authentic payment slips, correct vehicle plates, and accurate community directory records). Submitting fraudulent GCash/bank receipt screenshots or falsifying gate passes is strictly prohibited and constitutes a breach of these Terms.
  • Prohibited Acts: Users shall not attempt to breach tenant isolation logic, inject malicious scripts, scrape platform databases, or use the Platform to disseminate offensive, defamatory, or unlawful materials.

4. Intellectual Property Rights

  • Proprietary Software: The Platform, including its layouts, code structures, designs, text, and visual assets, is the exclusive proprietary property of WKNDPRJKT.
  • Limited License: We grant Community Associations a limited, non-exclusive, non-transferable, and revocable license to access and use the Platform for internal community operations. You may not copy, reverse-engineer, modify, or distribute any part of the software.

5. Disclaimer of Warranties and Limitation of Liability

  • "As-Is" Provision: The Platform is provided on an "AS IS" and "AS AVAILABLE" basis. We disclaim all warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
  • No Lawsuit Guarantee: WKNDPRJKT, its developers, partners, and affiliates shall not be liable for any direct, indirect, incidental, special, exemplary, or consequential damages (including loss of community funds, unauthorized access to databases, operational downtime, or disputes arising from incorrect accounting entries).
  • Local Governance: Community Associations agree to use the Platform in compliance with the Republic Act No. 9904 (Homeowners' Association Act of 2009) and the rules of the Department of Human Settlements and Urban Development (DHSUD).

6. Indemnification

Users agree to defend, indemnify, and hold harmless WKNDPRJKT and its developers from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with the User's access to or misuse of the Platform, violations of these Terms, or disputes with other community members.

7. Governing Law and Dispute Resolution

These Terms shall be governed by, interpreted, and construed in accordance with the laws of the Republic of the Philippines. Any legal action, suit, or proceeding arising out of or relating to these Terms shall be instituted exclusively in the competent courts of General Trias, Cavite, Philippines, with both parties waiving any other venue options.
